It used to be that there were yellow lines in places where you were obstructing traffic flow and if you parked on them you got fined which is fair enough. It was a criminal offence after all and they were there for a reason.
But in 1991 a new act of parliament gave local councils the power to decriminalise parking enforcement in their local area and collect the revenue for themselves.
In effect parking penalties changed from fines for crimes to another stealth tax all over the country.
People were so used to parking being illegal that they didn’t realise the change had happened as everywhere in the UK started to get covered with yellow lines.
In my view councils should be putting lines down to manage the traffic and reduce accidents. But instead they are drawing extra ones to make money.
A bit like speed cameras but the big difference I do mind is that if you get caught speeding as with any other crime you get a fair trial before an independent court. If you want to argue with a parking ticket your first port of call is the Council who issued it and after that a body called NPAS which appears to be funded by Manchester Council.
It’s a bit like your employer paying for the Judge at your employment tribunal against them, all wrong!

we lived near the hopital in dudley for years without any real problem recently they dudley council put double yellow line outside our home and know its costing us hundred of pound in parking fines, some off the residents were in there cars when tickets have been issued if this fair some off us got no where to park or is this another council tax. every one say its unfair but nothing seems to be happening

I have just been told that I cannot park my car on the road out side my run-up ON THE ROAD
because the MANCHESTER CITY COUNCIL TURNED UP TODAY SAYING I WOULD HAVE TO PAY 35 POUND OR MY CAR WOULD BE REMOVED AND TOOK INTO A COMPOUND. I WAS SO UPSET, THAT THEY TOLD ME THAT IF I PUT MY CAR ON THE OTHER SIDE OF THE ROAD IN EXACTLY THE SAME PLACE THEY WOULD SAY IT WAS O.K. APPARENTLY THE NEIGBOURS DAUGHTER WHO DOES NOT LIVE THERE COMPLAINED THAT SHE COULD NOT GET OFF THIER RUN UP AS SHE COULD NOT REVERSE, IT WAS IN NO WAY STOPPING HER FROM GETTING OFF.

Everything is becoming money orientated! just look how far we have come!
did people get fined for parking their horse and buggies in the past? I don't know.. but it seems that the introduction of cameras have made the police force into a money hungry department!! more and more as days go by new members join the departments where new ideas are put into practice on how to bleed the citizens of their money with fines! they know citizens WILL NEVER stand up against the governments , not like the past centuries.. because the system is so powerful now, once you made a noise you will be locked up!
the fines are gonna increase! and more and more cameras put up, and less parking spaces are going to come available to force citizens to park illegally so they can be fined!
wow, imagine 100 years from now! cameras will be EVERYWHERE!!!
they call us a free nation!! YEAH RIGHT!

Re post 230. Why do you not just pay the fine. You were parked illegally so just pay up and take more care in future. Double yellow lines are fairly obvious.

I stopped in Barking while looking for an address on my sat nav, I was in a quiet street for 2 minutes without getting out of my car.
It was double yellow lines with apparently no loading or waiting rules,
I have appealed but had it rejected,
I feel as i have been unfairly treated,
Can anybody advise what i should do as i don`t want to pay this fine

i'm worried that so many people who have been fined claim that they "didn't know it was illegal" to park where they did - bus-stop, pavement, ambulance bay, double-yellow line, on someone's foot etc. if you drive, then you SHOULD know - it's in the Highway Code, which you are supposed to have been tested on when you passed your test. if you don't know these basic rules, then perhaps you should be considered unfit to drive until you have remastered them and retaken your test. no more fines, just BAN you. perhaps that would make you take a little more care.

having fine for parking is one issue the other issue is the confusing and very-difficult-to-interpret signs that council set up which to me it seems to be more to trap drivers into being fined than help them. I got fined in one of these spots in Birmingham. When I got to my car it was being lifted onto a Lorry to be carried away. When I looked at the time fine was issued I saw it was 20 minutes before I arrive at the spot. They issued the fine and put a log on the car at the same time to be carried away. I didn't have any choice but to collect the car next day and pay £130. I didn't even know where I could get some help to defend myself.

I parked outside a garage with a "for rent" sign on it. It was clearly unoccupied and I left a sign in my car saying I was at a building 3 mins. walk away. The garage now has taken up two car parking spaces on a previously free parking area. There are no legal signs on the road, nor any put down to basically say "please don't park here" in wite or any other colour.
A warden came along and put a sticker on my car saying my car was parked causing an unnessary obstruction, under what looks like law B28A.
Although I have an off-road parking area people still sometimes block it, I leave a note on their windscreen to please keep my access free - maybe everytime this occurs I should demand the police come along and prosecute them.

Hello. Parking restrictions were introduced in my mum's road this year. I have been issued a parking ticket. I have stickers for the window but simply forgot as I was rushing to walk dogs in order to get to mum's house. She is virtually housebound and this is the reason me and my sister are there each day - really just to keep her company, cook and do some jobs for her. I believe the Council should have accepted my original informal appeal to say that on this occasion and because of the circumstances, they should 'let me off'. The restrictions have been in place for only about one year and I would contest that this is not long enough to be in the public conciousness. I also think that this fine does not really embrace the spirit of why these Laws are brought in in the first place - which surely is to enhance the quality of life for the people and the community. Instead, fines seem to be issued as a way of raising revenue. My case is going to the Tribunal in January. I would appreciate other peoples' comments on this type of thing. I intend to fight my corner with the Authorities and I want encouragement. Thanks. Lindy.

to everyone complaining of BLUE BADGE holders parking on double yellow lines,if they would check their facts ,it is illegal for disabled drivers to park on double yellows but only when the lines are accompanied by double yellow lines marked on the pavement,also most disabled people only park there because there is no suitable parking within reasonable walking distance,able bodied people shoul thank the lord they can still manage to walk so stop complaining about disabled drivers,please take my space but only if you take my illness

My local university is really busy on a monday and so opened up a field at the back of the parking area. I parked in there and was given a parking ticket for obstruction. This field had no parking bays, yellow lines and was literally just a green field. Can i dispute this. Any advice.

Yes the yellow lines are killing shops trade in the greater manchester area. I can remember people and shopkeepers parking outside shops all day in the 1960s. And no parking meters at all , and why not free parking every were, for good.

I parked in a deadend side street a few days ago in Croyden, came back to the car literally 20 minutes later to be greated by a £50.00 stealth tax ticket stuck to my windscreen,
And no time was the car out of my sight, for more than a few minutes, and some spineless little excuse for a human being managed to sneek up and stick this thing on my car,
To say i was ******* fuming would be like saying Tony B-liar was an honest an truthfull bloke...
And the thing that i find the most gaulling is if you pay within 14 days it's £50.00 as if thats not enough for parking somewhere for 20 minutes, but if you elect not to pay in the time the fee doubles, but you can appeal but not untill they've send you a letter if you haven't paid within 14 days, then you can appeal, but then of course the fine is £100.00 and if you loose the appeal which you more than likely will, you face a £100 bill....
B*stards.... money grabbing b*stards, every other day something else happens and i think why am i still in this country, and suffering being used as an open wallet, by people like this, who just want to wrench as much money form the already beleagered motorists pocket.

Do I have to pay a parking fine, if the ticket is miss-spelt? the ticket I recieved today said "without displaying the correct persil or voucher" What is a "persil"? apart from washing powder!!

What I don't understand is this:
If you pay Road fund Licenc, which makes it legal for you to drive/park etc on a public highway. Then why do you have to pay again when there is Pay and display at the side of a public road, surely this is paying twice and can't be legal?

A ticket issued for parking on yellow lines is invalid if the lines are broken in anyway at any point (other than for current road works - they must be repainted afterward!!!), if they are not 'ended' with a double TT bar, or if the there is no yellow sign stating the period of operation.
Failure to correctly and specifically identify the offence under the road traffic act on a ticket automatically makes it invalid. as does the incorrect time date or reference identifying the car (eg slightly wrong reg), as does omited or vague information such as "8PM"a 24 hour (08:00) time must be stated.
If your car is bigger (longer) than the space where defined spaces are painted on the floor, you cannot be done provided you have not gone into another bay by an excessive amount - leave the rear in the road.
In all cases take photos of the car and the reason for appeal (the council might have got out with a tin of paint an hour later etc) and if possible obtain an independent witness to validate your case.
Wardens are often sacked for repeat errors - some are employed by private companies which is a joke anyway - how a private company can be tasked with upholding and enforcing any legal infraction on a public highway - that in its self is in truth an infraction of law (LOL).
Finaly on private car parks not one opperated or linked to the local coucil (eg say a taxi firm or a gym car park) if you get a private ticket or demand through the post, dont pay it - the legal can of worms these fly-by-night private people have to go through is vast and law is on you side (its called extortion in some cases!) and the costs they often incur in court not that then often go there scares the pants off them!

Many bus stops have not been converted into bus stop clearways. In the Traffic Signs Regulations and General Directions 2002 it states that after 1st Jan 2007 all bus stop road markings that have not been converted into bus stop clearways should be removed.
A bus stop clearway comprises of a yellow box with bus stop text and a thick yellow line(100mm) next to the kerb. It should also have a sign stating the operating times of the clearway or the times omitted if it operates 24 hours a day.
Without the yellow line or sign the bus stop markings have no legal standing.

i received a ticket for parking on a pathed area outside a cinema,. the violation stated on the ticket was "not parked correctly within the markings of the bay or space" i wasnt parked anywhere near any markings , the issuer should have ticked the "other" box and specified the violation, does that mean my ticket is invalid because the actual violation does not match the stated violation on the ticket?
otherwise if you dont park correctly you should expect a ticket.

The Bill of Rights of 1689 says that all Grants and promises of Fines and Forfeitures of Particular persons before Conviction is illegal and void.
Basically all Penalty Charge Notices are illegal because the Road Traffic Act 1991 is not a Fiscal Act and cannot be used for revenue raising which is what the government is using it for in defiance of the law, and the RTA 91 is in conflict with the Bill of Rights and the Lord Justice Laws judgement in the Metric Martyrs case.

| have been issued a fine for 80 pound for a parking ticket that i did'nt reiceve. a few months ago i was parked on a yellow line with a disabled badge unknown to me the part of yellow line i was on had restrictions... no stopping or loading. as i moved off i saw a traffic warden and asked why i was given a ticket, he said he did not issue the ticket and that i should check the the wardens number. when i opened the yellow plastic envelope there was no ticket in side. i asked the warden what i should do... and he said there is nothing to do becouse i do not have a ticket. and now three month later i have received an 80 pound fine. this can't be right... were do i stand with the law???? can any one help.

I would like to comment from the other side of the fence apropos parking fines. Street illegal parking enforcement is a non-entity in Stockport.
Mersey and Borron Streets have been decreed by the police as a no-go area in Stockport, the UK capital of illegal pavement parking. Vehicle anti-social behaviour is rampant in this medieval town and the police and council are aiding and abetting illegal activity.
You only need to Google 'stockport illegal pavement parking' and you will find numerous sites about this illegal activity and not only in Stockport, but all over the country.
So if you want guaranteed immunity from illegal parking penalties then sell up and move to Stockport.

If you fill you have been given a Penalty Charge Notice that you should not have been give contest it, this freezes the fine untill they reply.
If all driver did this they could not reply to all of them and they would lose money.
Nearly 50% of charge notices can be contested and get stop at the Adudicators
You then can claim for you lost time
